Our Commitment to Intellectual Property Rights

At ImageFix.site ("we," "our," or "us"), we respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we have implemented a policy to expeditiously respond to claims of copyright infringement.

This DMCA Policy explains:

How to report copyright infringement on our website

How we handle takedown notices

How to file a counter-notice if your content was removed by mistake

Our policy on repeat infringers

By using ImageFix.site, you agree to comply with this policy and all applicable copyright laws.

1. Our Role as a Service Provider

ImageFix.site is an Online Service Provider (OSP) offering free browser-based image editing tools. We do not host user-uploaded images on a public gallery, and we do not claim ownership of any content you upload.

How our Service works:

Users upload images solely for temporary processing (compression, resizing, conversion, etc.)

All uploaded files are automatically deleted from our servers within 1 hour

We do not allow public sharing or hosting of uploaded content

Despite our transient processing model, we take copyright infringement seriously and maintain a designated agent to receive DMCA notices.

2. Reporting Copyright Infringement (Takedown Notice)

If you believe that your copyrighted work has been used on ImageFix.site in a way that constitutes copyright infringement, please send a written notice to our Designated Copyright Agent.

2.1 DMCA Takedown Notice Requirements

To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following elements:

Signature: A physical or electronic signature of a person authorized to act on behalf of the copyright owner.

Identification of the Copyrighted Work: A description of the copyrighted work you claim has been infringed. If multiple works are covered, provide a representative list.

Identification of Infringing Material: Information reasonably sufficient to locate the allegedly infringing material on our site (e.g., specific URLs).

Contact Information: Your name, mailing address, telephone number, and email address.

Good Faith Statement: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

Accuracy Statement: A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

2.2 Where to Send Your Notice

Please send all DMCA takedown notices to our Designated Copyright Agent:

📧 Email: dmca@imagefix.site
📬 Subject Line: "DMCA Takedown Notice"

Note: For security and tracking purposes, email is our preferred method. We will confirm receipt of compliant notices within 2 business days.

3. Our Response to Valid Takedown Notices

Upon receipt of a compliant DMCA takedown notice, we will:

Review the notice for completeness and accuracy

Remove or disable access to the allegedly infringing material expeditiously

Notify the user who uploaded the material (if identifiable) that content has been removed

Provide the user with a copy of the takedown notice and information about filing a counter-notice

Document the takedown for our records and repeat infringer tracking

We aim to process valid notices within 24–72 hours.

3.1 Incomplete Notices

If your notice does not substantially comply with the requirements above, we may not be able to act on it. In such cases, we may contact you to request additional information.

3.2 Misrepresentation Warning

Be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees. Please ensure your claim is accurate and made in good faith.

4. Counter-Notification (If Your Content Was Removed)

If you believe your content was removed due to a mistake or misidentification, you may submit a counter-notice to our Designated Agent.

4.1 Counter-Notice Requirements

Your counter-notice must include:

Signature: Your physical or electronic signature.

Identification of Removed Material: Description of the material removed and its location before removal.

Contact Information: Your name, address, telephone number, and email.

Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., any judicial district where we may be found).

Statement of Good Faith: A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.

4.2 What Happens Next

Upon receiving a valid counter-notice:

We will forward a copy to the original complainant

We will inform them that we may restore the content in 10–14 business days

Unless the complainant files a court action seeking to restrain the activity, we may restore the content

5. Repeat Infringer Policy

In accordance with the DMCA and to maintain our safe harbor protections, ImageFix.site maintains a policy of terminating users who are repeat infringers in appropriate circumstances.

5.1 How We Identify Repeat Infringers

Given our service model (no accounts required, transient file processing), we track infringement reports associated with:

Email addresses (if provided in takedown notices)

IP addresses (where legally permissible)

5.2 Termination Policy

First Violation: Warning and removal of content

Second Violation: Potential account termination or IP block

Multiple Violations: Permanent termination and legal action if warranted

We reserve the right to terminate access to our Service for users who repeatedly infringe copyrights, whether or not we have been formally notified of every instance.

6. User Responsibilities

By uploading content to ImageFix.site, you agree that:

You own the copyright to the images or have permission from the copyright owner

You will not upload content that infringes third-party rights

You understand that we do not verify ownership of uploaded content

You accept responsibility for any copyright claims arising from your uploads

We do not monitor user uploads for infringement. However, upon receiving valid DMCA notices, we will act expeditiously.

7. Designated Copyright Agent

In accordance with 17 U.S.C. § 512(c)(2), our Designated Agent to receive notifications of claimed infringement is:
